The man whom authorities say caused the chain-reaction train derailment that killed 11 people could face murder charges for leaving his sport utility vehicle on a railroad track after apparently changing his mind about committing suicide. Nearly 200 were injured.

So, he will surely go with the insanity plea. Can this man avoid punishment in the name of "treatment?"

etothepii if I am not mistaken in California what the insanity plea gets you is basically the equavilant of a guilty plea, except first you get sent to the looney bin, once they declare you sane then you start serving your sentence in prison!

Well I doubt if the state will charge him with 1st degree murder because I doubt if it was premeditated, but then again there are what they refer to as extinuating circumstances that could allow them to charge him with 1st degree murder.

In my opinion,he committed suicide when he killed all those innocent people.Now it is his turn to die.We shouldn't support him for the rest of his life because he killed innocent people,we should put him to death and very quickly as to not cost the taxpayers more money.

I don't buy this "insanity" crap that people try to use to get out of crimes they committed. If someone committs murder, aren't they then "insane" from the normal scope of society? Makes no sense to me, especially stating that he was trying to committ suicide first. He could have very easily stood in front of the train!! I think he is just stating that now, after the fact, so as to show people that he wants help, maybe to save his ass and buy him life in prison in stead of death. I say they take him out back and get him done with. Or I will, and it won't cost them but a plane ticket to L.A. and back, and a bullet
