If you are not presenting an immanent threat of serious bodily harm or death to the other guy (thus not justifing his use of deadly force against you), and he shoots at you (thereby becoming an immenent threat of serious bodily harm or death to you), then you are legally authorized to use deadly force to defend yourself.

DING DING DING!!!! Driftrider nailed it perfectly, right here....
I carry my Taurus .38sp snubby with me when bowhunting (yes, I have a CWP in Virginia). If some crazed lunatic came up to me in my tree stand on public land, hollering at me and then points a smokepole or shotgun or whatever at me, and fires a shot, I'm gonna whip out the .38sp snubby to defend myself. See, I can't run anywhere... I'm in a tree stand, remember? I'm treed like a raccoon and can't do anything about it. I
have to defend myself given this type of scenario. Now, if I was on the ground, I'd back up and haul a$$ outta there and probably hide behind the biggest tree I could find, while I reach for the .38sp snubby.
