Default You think it's the lawyers that are ruining this country?

Had a thought: How many politicians started out as lawyers or at least have a law degree?

Ok my point.....

Nearly every day we hear about stupid law suits, well here's another one - this made me think how destructive lawyers are.

Had a round bale delivered to the pasture for the horses by an old farmer guy. This guy is your typical retired genuine farmer that wouldn't hurt anyone but rather just wants to live out his days selling hay and raising a few animals on his property - his property that has been a farm for generations. The property next door sold and a woman built a huge house complete with paved driveway and swimming pool. She sued the farmer because she wanted his barns and outbuildings leveled and all the animals taken away. (My gut starts hurting just thinking about a slob like this, even worse when I think about the lawyer representing her. [:'(][:@]) Long story short, the farmer spent thousands of dollars through several lawyers and several appeals. In the end he won and the witch sold and moved out, but it cost him many thousands of dollars, probably much of his retirement to defend his property and his lifestyle. The nerve of some people - move in next door to a farm and have the idea that they have to get rid of animals and buildings for them. But the real skunk in this picture to me is the her attorney.

It may not be the lawyers all by themselves but they sure are greasing the skids! It is way past time for some "loser pays" legislation to be passed, that and the ability to sue lawyers for malpractice as well as the schools they were graduated from for foisting them upon us. The american trial lawyers association is in the fore of the gang trying to sue gun manufacturers for the mis-use of their products, why not sue the law schools for their faulty devices.

Unless I'm mistaken Michigan probably has a "Right to farm" law similar to Indiana's , so the case should never have made it to court in the first place . The farmer should look into this angle and consider suing her for restraint of trade .

What happened to good old common sense? If you don't want to smell horse poo, then don't move out into the country. DUH!


I think it's the lawyers, the courts, and the legislators that are to blame.

All civil suits should have to be reviewed by a grand jury, very similar to a criminal grand jury. If the grand jury finds the suit has merit, it should be able to procede normaly. If the grand jury finds the suit is without merit, I believe it should be legal to procede, but the plantiff and plantiff's attorney should be responsible for ALL costs of the defendant, should the plaintif lose. This would drasticly cut down on the number of BS lawsuits.

Charley I agree! Let me add this. I am not defending lawyers but lawyers can only work with past rulings and present laws in defending or prosecuting a case. When a judge makes a ruling, he is saying that given the evidences presented this is how he "interprets" the law and cites past cases to back up his claim and therein lies the problem.
One day some judge (former practicing lawyer) made a ruling and it either was never appealed or was and another judge agreed and over time things can get really messed up and common sense and laws as they were intended become muddy at best. It becomes a growing snowball.
It's almost like a feeding frenzy. Once someone wins $$$$$$$$$$$$$$$ then greed kicks in and suing begets suing.
It is easy to say this needs to stop but once a ruling has been made and run its gauntlet of appeals, it goes into the books and becomes fodder for the next hungry lawyer.

Trial lawyers are ruining this country. a wrongful death suit was filed here today because some lady ran into a light pole while skiing...i mean, when you ski, dont you sign a waiver saying that the place isnt responsible for your death? all these suits on gun makers, drug companies, doctors, and tobocca companies are a load of crap and they need to start clamping down on these fools. These guys make 30% off the top in attornies fees..money hungry thieves is what they are.

Its $$ that runs the country - not lawyers. Lawyers are merely a byproduct of the lust for $$$.

I did hear in my younger days that we had a Republic at one time in America, but I'm not too sure when that was.[&:]
