Apparently the parents of the victim that was beheaded by a guide wire in the drunken auto accident are requesting the driver not be charged with murder - the two families are very close as were their sons. They claim it was just an accident and don't want to see the driver spend the rest of his life in jail because of this.
Ok, so you leave the bar so drunk that you hit curbs, get all bloody by killing your friend and wake up still drunk not remembering any of it. I would say he is guilty.
The question is though, even if the parents had the right to dismiss the charge, should it be dropped just because they were friends and it was afterall, just an accident?

In any case, I really don't care what the victim's family wants. If the law is broken, you should pay for the crime. The man was drunk as a skunk, driving all over the road. That right there should equal jail time, IMHO.

Sure haven't. Anyone who thinks it's not a big deal need to pull his head out of the sand. There is absolutely no excuse for it whatsoever. We all know that alcohol impairs judgement. If you drink at all, don't drive!
of course its a big deal, he could have met a family head on, could have been much worse; fortunately the only person killed was the one person who was just as responsible for the accident, the drunken passenger. the man does not deserve a life behind bars. 3-5 yrs to think about it yes, unless of course he has a history with this type of problem ie dui.

I understand where you're coming from, but I respectfully disagree. The vitcim was hanging out the window when the driver swerved onto the shoulder, bringing the vehicle within reach of the wire. Were he sober and able to stay within his lane, his best friend might possibly be alive today.

Don't forget that in most states, if not all, the driver of the vehicle is ultimately responsible for the vehicle itself, as well as the occupants. Legally speaking, this particular case does not fall into a gray area.
