This is an odd story, but I can't help but focus on the last paragraph.
Quote:
"It is not a normal or legal thing, anywhere in the country to carry a handgun without a permit while selling ice cream," said Sgt. Eric Holtzclaw, a spokesman with the Enid Police Department.
Vermont and Alaska are part of the U.S. the last time I checked. I guess Sgt. Holtzclaw doesn't get out much.
I know that some states allow employees to carry while at their place of work. Can anyone tell me if a company vehicle can be considered the place of work of the driver in any of those states?

I might be mistaken, but I believe in Maine you can carry anything (legal) as long as it is in plain sight. You need a permit to carry one concealed.
Excellent point! I'm not sure if OK allows open carry without a permit (like Virginia does). According to the article, he took out the pistol, so I'm assuming it was hidden from view.

Ahaha! I visited packing.org and found the following on the Oklahoma page.

Peaceable journey law summary:

There is no Peaceable Journey in Oklahoma. You must have an Oklahoma permit or a permit issued by a state they honor to carry a firearm concealed on your person or in your vehicle. You can transport a firearm that is unloaded and secured in the truck of your vehicle.
Still, is an ice cream truck a "place of employment"?
RE: I'd like an ice cream cone with some lead on top....
I believe here in Georgia it would be perfectly legal to pack heat while selling ice........cream. Perhaps this Sgt. should receive some correspondence from the rest of the country. I can't believe anybody from OK. could be that dense.

RE: I'd like an ice cream cone with some lead on top....
Calhunter,
While the ice cream vendor was probably not in the right in this case,( firing shots into the ground) there are many places where it is perfectly legal to carry a weapon even without a permit. Here in Georgia, it is legal to carry a loaded weapon in your vehicle either exposed to plain view on the seat beside you or in the glove box. With a CCL it is legal to carry concealed under many other circumstances including onto school grounds.
While this Sgt. was well within his right to criticize the ice cream vendor based upon Edin OK law, and the vendors action, the statement declaring it illegal in "Every other city" is incorrect.
RE: I'd like an ice cream cone with some lead on top....
if he was an independant contractor who owned the truck outright , its his business. However if was an employee and driving the companys truck , he has to follow the rules of the company. So if it wasnt his truck , its considered a place of employment

Let me rephrase what I was yanking your chain about.

Calhunter, Let me re-phrase that last sentence then, " I can't believe anybody could be that dense" But of course we know there are those that are and always will be. Some folks even have to work with and for people like that. On the other hand, knowing the so called journalists working out in this world, the Sgt. may have been mis-quoted or even quoted out of context.
