Default Speaking of suing

I was in a log plume ( dont laugh it still hurts ) accident two weeks ago. This was
a result of neligence by the amusement park. They stopped the ride to change shifts at the end of the ride,however they did not notify the people at the front of the ride that it was stopped. So there I was waiting to go up the last hill and BAM ! I get smashed from behind by a log plume full of people. My neck and my shoulder still hurt. The emergency room basically said I was in a car accident. I am going to physical therapy next week , but am debating on calling a lawyer. Evem my Dr. says I clearly have a case. So my question is , when you have the proverbial " hammer " should you swing it ?

Hmmm. I would say yes. At least to cover your costs incurred because of their negligence - sounds like they are indeed clearly at fault. I'm not one for suing for millions claiming the accident caused you severe emotional trauma, unless of course you are scared stiff every time you see a log. Would suck for trying to hunt out of a stand. (Sorry, couldn't resist!)

I'm outta pocket like $200 so far. Didnt get the ER or the physical therapy bill yet.

Yes, I would take legal action against the amusement park. There's no excuse for that kind of preventable mishap, and you don't deserve to have to put up with it.

I would take on the amusement park to cover the costs of your medical bills and for any work missed, if possible, but good luck finding an attorney to take on a case for that small of a settlement. So, I guess I wouldn't sue.

Asking for hundreds of thousands or millions is nothing but immoral and unethical and is basically the equivalent of theft.

I've been good, thanks. I had to take a break from this place because of work and being so busy around the house. New construction so we had a huge project ahead of us with planting the yard and all. Still not done, but getting there.

Wouldnt even think of it. I missed almost a week of work and have CAT scans and Xrays
that show my injury. I at least want what I used in vacation time plus my out of pocket expenses.

CAT scans are not cheap, and if you're like me, your vacation time is especially valuable. I don't see how anyone but the amusement park is responsible.

everyone at the ride when I got off acted like nothing happened. The girl at the top of the drop was almost in tears saying sorry every 3 seconds. It wasnt until I went to the first aid tent that the suits came. He was saying the ride is computer operated and it couldnt have been their fault. I watched the girl pull the stop lever so her replacement could get up the steps , and this guy is like " its computer operated ". Believe me there was no computer on this POS ride. He pissed me off royaly, just wanted to cover his ass. So i filled out an accident report and left. Guess I'll be contacting them in the near future. Just scheduled my PT ....3 times a week for a month.
