I'm not an expert on international criminal law, but I would imagine that it's up to the new Iraqi government to try Hussein. He may have been a blood-thirsty tyrant, but he didn't commit any crimes on our soil, enemy or not. He killed his own people, and they should be the ones to seek justice (with our assistance, naturally).
We're going to remain in country providing security until things settle down, so I don't see any reason to hand Hussein over just yet. We can detain and transport him during the proceedings. I have no faith in the Iraqi police and military forces to maintain order, at least not anytime in the immediate future.
If he is to be executed, then the Iraqis should also do that (their court, after all). Plus, if we are the ones who kill him, that'll just be one more whining point for international lefties who argue that we have no authority to invade the country or arrest its leader.
