Actually if you look at the California Assault Weapons Idenification Guide by the CA Attorney General.
Category 1 Second Paragraph reads:
Except as otherwise noted, firearms described in this publication have been physically identified as assault weapons by their markings.
Those markings generaly,but not always,include both the name and trademark of the manufacturer and the model name or number of the firearm. Each description include identification markings and an indication or where those markings, if any are found on the firearm.
Later on on page 26 in firearm identification.
There is a picture of a Berreta AR 70
In the comments box it reads.
May be marked Mod70S or Mod 70 sport. However, only the mark AR70 is essential to identify this as an assault weapon.
MY QUESTION IS...... IS THIS TO VAGUE? COULD THE OFFICER SEEING A WINCHESTER MODEL 70 MAKE THE MISTAKE OR USE THIS AS A TOOL TO TAKE AWAY THE MODEL 70? AT LEAST LONG ENOUGH TO FIND HIS MISTAKE, THEN MAYBE THE RIFLE WOULD BE RETURNED IN A MONTH OR SO.
ISN'T THIS HOW MISTAKES CAN HAPPEN?
