So if your wife, kid por someone you care about dies otr is severly injured because of incompotence of a doctor you shouldn't be able to find a lawyer ,right?

Turn on your sarcasm detector, please. Of course this would not be a fair (or legal) way to practice medicine. But Dr. Hawk is trying to make a point, and one that needs to be made, IMHO. No doctor in his/her right mind would expect the AMA to endorse such a thing, but he's getting the national media attention he wanted.
Incidentally, I was a juror in a bogus medical malpractice lawsuit a few years back. Basically a woman died because she was "morbidly obese" so that she was bed-ridden. One day, she tried rolling out of bed, and a clot broke loose from her leg and lodged in her pulmonary artery. It was sad because she had a daughter, but it wasn't her doctor's fault that she didn't heed his warnings to eat properly and exercise. She had gained over 100 lbs. since she began seeing him.
