Default Federal Judge rules Partial birth Ban Unconstitutional

SAN FRANCISCO(AP) A federal judge Tuesday declared the Partial-Birth Abortion Ban Act unconstitutional, saying the measure infringes on a woman's right to choose.

The ruling applies to Planned Parenthood clinics and their doctors, who perform roughly half the nation's abortions.

U.S. District Judge Phyllis Hamilton's ruling came in one of three lawsuits challenging the legislation President Bush signed last year.

"The act poses an undue burden on a woman's right to choose an abortion," she wrote.

Federal judges in New York and Nebraska also heard challenges to the law earlier this year but have yet to rule.

Bush signed the bill in November, saying "a terrible form of violence has been directed against children who are inches from birth while the law looked the other way."

In the banned procedure known as intact dilation and extraction to doctors, but called partial-birth abortion by opponents the living fetus is partially removed from the womb, and its skull is punctured or crushed.

Justice Department attorneys argued that the procedure is inhumane, causes pain to the fetus and is never medically necessary.

Abortion proponents, however, argued that a woman's health during an abortion is more important than how the fetus is terminated, and that the banned method is often a safer solution that a conventional abortion, in which the fetus is dismembered in the womb and then removed in pieces.

Nuff said. This is what I have come to expect from that Godless, morally barren place. In typical liberal fashion, they create law judiciously because a majority-rule legislative process would never allow it to happen. This is why GW needs to continue his recess appointments of federal judges.

That Right doesn't exist, its fictious and every other law currently on Federal and State books says so.

Don't believe me ? Ask all the pregnant womeon convicted of abusing their unborn children. Ask Scott Peterson after he's found guilty of double murder.

Any law thats passed anymore will be overturned by some dumbass liberal judge trying to make a name for themselves. Pass a law that says you can't crush and aluminum can with your head and some idiot would find a reason and a judge to stand up and overturn it for some stupid reason or the other !

It's that same damn 9th court...
they are nothing but a judicial scourge on this country.

They are the most overturned and the most corrupt in actually doing their job.

Of course Bush said he was going to split the 9th up ( and I'm sure it wasn't actually his idea) ............ waiting.......... waiting........... waiting..............

You guys know that I am pro choice up to a point but this makes me sick. How can any one with a spec of morals actually perform such an act and then have the law support the same act.

Well if they use the "Women's Choice" cry, what about the Child's choice?

The women has choices, no sex, birth control, adoption, or raising the Child? Aren't those choices?

Stealthy hit it on the head, only if your an Abortion doctor, can you harm an unborn Child[:@][:@][:@]

I remember when we got pregnant with our first, the Doc raised that question if some of the tests came back that the baby would be greatly deformed or some other problem. It took me about 30 seconds to decide, that it's not up to us, but God if that baby is to come to the world and we'd love it no matter what.Now that I am a parent there is nothing I could ever do to a Child of mine, born or not to not give it an opportunity.

I think most these people, if they had Kids of their own it may change there attitude a little.

I don't think that abortion should be legal at all! Playing the devils advocate here though, say abortion is OK, up to the point of birth. What dumbass woman would take nine full months to decide on an abortion? John Kerry?
