A man who worked for 3 years at Catapillar was picked randomly for a drug screening, according to contractural agreements with the union. The man reportedly drank lots and lots of water and after 3 hours still could not pee. He suffers from a medical condition. Catapillar fired him despite the rare medical condition cited by doctors.
The man soon after took a "hair" test and paid for it himself. A hair test is known to be much more accurate and any substance abuse can last for months after using drugs, but Catapillar still refused to change their stance. The man is suing Catapillar to get his job back and for back pay.
This story first broke well over a week ago and received a nominal amount of coverage with no more details forthcoming in the interim.
While on the face of it this seems extreme, I wonder what the rest of the story might be. The union and the company have agreed to the tests and the consequences of either failing or being unwilling/unable to take the "Whiz Quiz" and from my experience with unions the company may not have been allowed, by contract, to take any other action. Allowing one employee to do anything differently than any other employee opens a can of worms. If the union wants their membership to have this alternative, then the next collective bargaining session should include this issue. I don't know the difference in cost or time for results of the two methods but you are correct in stating that the hair sample is more accurate and actually covers a longer period of time. Again, I would like to know more of what is behind this.
BTW, the "Medical condition" referred to is known in lay terms as a "Shy Kidney". To my knowledge it is not covered in the Americans with disabilities act as the man seems to want us to believe.
I don't doubt it in the least. When the economy takes a dumper, these damn corporations become ruthless sadistic sons a beotches.
I worked for G.E. in the past and their pee test was me stripping down in a room, putting on a paper hospital gown, the nurse shut off all water to a sink and toilet and i had to leak in a cup IN FRONT OF HER. Then she let me put my clothes back on.
Really humiliting especially considering that she was a complete dog.
If that was the only reason that he was fired I hope he sues their arses off and wins millions. Especially if he paid to have a hair test done at his own expense.

And if he can medically document the condition and his hair test came back clean may the jury be even more generous . Whiz quizzes are bad enough , but when they're not willing to even give you the chance to defend yourself they go too far .

Nobody has bothered to check to see what his union has to say about this. Many times union agreements are the issue more than what the company demands. It may very well be that they cannot use the hair test due to this. Why is it that everybody is so willing to see only the bad that the "Company" has supposedly perpetrated and none of the chicanery of the union?
This guy new of the requirement when he signed on and was apparently able to perform at that time, why not now?
