Default if you EBAY or buy/sell/trade online, PLEASE read !

do a lot of EBAY, and buying and selling through classifieds etc. Its very rare I have a problem of any kind, but I am involved in a dispute right now and want to heads up everyone on a couple of items.

My situation is I sold 3 auctions of books on EBAY, and the buyer wanted to combine shipping. He also wanted to send media mail and no delivery confirmation or insurance. Total ammount was approx $25 per auction. I agreed, and he paid with Paypal. I sent the books (his address was unconfirmed but he had like 1200 buys) in one box and that was that.

My bad luck, the box of books were lost. He sent very rude and demanding emails the longer the books were lost and finally filed Pyapl complaints saying they did not arrive. As the emails and his rudeness progressed, I became less and less likely to find a mutal resolution.

The books finally showed up at his house, but he claims the box was damaged and a few books missing. He drops one claim but leaves the other and wants me to pay him for the missing books. Thats ironic to me, that he didn't believe I sent him the books, but wants me to believe when he got them there were some missing. I didn't pay him and he left the claim and Paypal filed in his favor.

Now, the important part I want ya'll to hear.

NEVER send or buy without delivery confirmation and if its over $100 make is signature confirmation. ALWAYS, without fail. Paypal will never back the seller without that.

NEVER send to a non-confirmed address using Pyapl payment. Never. Seller takes the chance of forfeiting Seller Protection by doing so.

Never send mutiple auctions together without a Paypal payment specifically requesting you do so.

Emails from buyers are NEVER proof of anything unless its a direct email - no forwards, copy's and pastes or anything like that.

After the Paypal ruling in his favor I contacted all the EBAYers that had problems with him (through neg feedback) and 12-15 people responded by saying he pulled the same crap with them, the same way. They all caved in and gave him money etc to keep from getting negative feedback. I didn't. I filed my appeal and have followed up with a lot of emails proving that he did in fact recieve the box of books. The latest was his negative feedback to me tonight, in which he said yes, he got the books but was #1 poorly packaged, #2 bad seller (me) and #3 recieved some of the books but not all of them.

I dont know that Paypal will reverse the decision or not basd on the proof that his claim was for items not recieved, not items recieved but damaged. One of his emails asked if I wanted to challenge him or not ... and thats what I'm doing. Had he been easier to deal with I'd have reimbursed him for the missing books and it'd have been a done deal. A smarter person might have anyway

Ya'll just remember to NEVER send without delivery or signature confirmation, EVER ! I have like 460 EBAY buys/sells and I've bought/sold/trade to a lot of guys on our favorite classifieds sites and still got suckered. My policy has now changed and it'll cost everyone more money, but it'll be almost bombproof when I send an item or pay for one to be sent to me.

Stealthycat, Stick to your guns!! My wife had a similar experience and eventually came out on top of the situation. I believe she went over the heads of the "Arbitrators" at ebay and made her point to one of the top people. If you need any help she may be able to tell you how she went about it. Send me a direct email if you would like her input.

I'll have to get the details from my room-mates girlfriend, she can give you some real warnings about e-bay. Her identity was stolen and a crook tried to sell an R-1 (big $ sportbike) that never existed using her good standing. She still hasn't sorted it all out but can't use e-bay now because everyone thinks shes a con-artist.

Since other sellers appear to have had the same kind of experiences with this guy, I'd think that e-Bay would take this fact into consideration in deciding your case.....

Update : If you Paypal and do not use delivery confirmation, the buyer will win the case every time and the seller will lose. A great loophole for all you con artists and scammers out there !

I have one final shot at winning my appeal - Paypal realizes he canceled the first claim because items were recieved - and they want him to email them and confirm that the books did arrive. If he does this, they will reverse the decision, of course, I doubt he's fool enough now that he has his money AND the books !

Unreal

The guy emailed me this morning saying Paypal wanted to know why he canceled the first complaint because the books arrived but left the second calim that the books didn't arrive open that resulted in his refund. Said he still wanted to "make a deal" to put all this behind us.

Lets see now, he has the books, got the one complaint won in his favor ... why would he want to deal at this point unless Paypal has placed that refund to him on hold until he can explain himself ?

I will not be able to erase the EBAY negative feedback, I had already left him positive so I am screwed there. What to do, what to do ...... we'll see how much $$$ he wants, but I'm thinking I went this far, its all or nothing now.

Because I'm right

Stealthy, I buy/sell on ebay a fair amount and use Paypal so this is interesting to me.

Here's what I dont' understand. How would have delivery confirmation have helped you out? Yes it would have proved that they were delivered but now that's not what his complaint is. He's claiming not all the books arrived? A delivery confirmation wouldn't have stopped that claim.

If you do get this resolved in your favor, I'd talk to ebay about getting the negative feedback removed from your account. If you are resolved of a wrong doing it's not fair to get neg. feedback. At the very least you need to go into your own feed back and leave a rebuttle for his negative feedback.

That really sucks but I'm like you, I think I'd fight it, especially since you know you are right. It sounds like this guy has been down this road before and he knows how to work the system. Good luck and keep us informed.

TXCowboy, it would have helped him on the first complaint because he would have had proof that the package had been shipped and he would have been able to track it. The second complaint may not then have occured although it may have if the package had indeed been damaged. I don't understand why the buyer insisted on no proof of delivery and no insurance though, that's kind of suspicious to me.
