Default There is such a thing as a "good" lawyer.

Thought I'd share this with you and see what you think.

Recently a friend of mine had two beers at a buddy's house before making the 15 minute drive home. He had an open beer between his legs - "one for the road", that he had only taken a few swigs from. He was not drunk, buzzed, or even legally drunk. The chemicals he had in his van overtook him rendering him unconscious. He took out several mail boxes, ran through a four way stop and finally stopped when his van hit a rock. He woke up in the hospital handcuffed to the bed. He didn't remember any of this and had no idea why he was in the hospital. No one was injured including himself. He had so much CO2 in his blood it almost killed him. He went to jail and was charged with a DUI, reckless driving, leaving the scene of an accident, and open intoxicants. He stood a chance to lose his license, which would have put him out of business. After a couple of court hearings, the judge recommended he come back with legal council. He came back, but with no attorney, and made a plea to the judge to drop the charges - he had all the toxoligy reports and whatnot with him. As the state prosecuting attorney was making his case against my buddy to the judge with intent of frying his butt, another attorney in the court room asked to approach the judge. After a few minutes, this attorney, walked my buddy out of the court room and explained that he had read the entire case and was going to ask the judge to drop the charges, which ultimately, the judge did. My buddy asked this guy what he could do to repay him. The attorney replied, "You owe me nothing, but if you would like, let my payment be your word. Tell everyone you know that not ALL attorneys are crooked wretched scum bags that want to turn criminals loose. There are a few of us left that are good."

Think my buddy should have had the book thrown at him?

I think that the judge made a good call.

I think the guy shouldn't drive while drinking a beer and should get his exhaust fixed.

Not all lawyers are bad.We have a couple lawyers that have kids in the football league that are more then willing to give free advice. We had a sticky situation this year and the one guy really helped out quite a bit.

Yes, he should not have had an open beer. But he wasn't drunk.

It wasn't exhaust that got to him. He picked up some chemicals for his business earlier that day and a jug tipped over and breaking the cap. That's what knocked him out.

He probably should have gotten popped with open intoxicants -$50 fine.

If he did that around here he would be getting bent over like girly man in prison.
I can GUARANTEE that he would have gotten crucified in wisconsin.

The only way you don't get popped around here is if it is a life or death situation. EG: your wife cut her legs off in a freak blender accident and you've been drinking - you can rush her to the hospital in that case, and if you get stopped you can use the life/death argument in court and you might get off.

He was. The cops ticketed him for leaving the scene because he didn't have control over his vehicle after he hit several mailboxes. Funny world we live in.

It wasn't earlier in the day Charlie - he got in his van, and passed out minutes after breathing the heavy fumes from the chemicals he didn't know had spilled.
