Can a person get false accusation charges automatically filled on them in the
case of statutory laws?

Let me set up the situation:

I know a young man, who is still in high school. He is under house arrest for
statutory rape. The little girl in question could very easily be
making false accusations. If so, this young man has just had his life ruined.
His school is suffering miserably. This will lead to problems with getting
into collage, not to mention the stigma that will follow him. No telling how
much money this will cost his family. Now if the little girl is found to be
lieing, is it just all blown off since it is a statutory case, or will there be
consequences she will have to face?


Dont get me wrong, if this young man is guilty, I have on sympathy for him.
But if he is innocent, his life has been ruined.

I dont know much about the case, it just fueled my curiosity. I didn"™t know
if the family had any responsibility, being it is a statutory case. Here in
Texas that makes any allegation an automatic inquiry, doesn"™t it?

He's 18 and in High school ??? how dumb is this kid??

Look into "romeo and juliet" laws.

as a retired deputy sheriff the laws are even crazier to me sometimes.in texas the girl can not give her own consent if a minor even if she says yes.has this been to trial?i can not understand why he is under house arrest?if he is 18 he can be charged with sex assault of a child if it happened while he was 18.there are too many variable to draw a conclusion.has he been charged?has he gone to trial?is he out on bond?were their any stipulations with the bond?the constitution says innocent until proven guilty but it is actually right the opposite. anyone can make an accusation, did this case go to the grand jury? did he get no billed or a true bill?if the bot is found innocent it does not mean the girl lied. if the girl has been found to have lied she can be prosecuted.the boy can seel civil remedies by filing a lawsuit.if you can get more info maybe i can explain better.

all that is required for case is that someone files a criminalk complaint with the police or da's office.it will get an investigation if the complaint appear founded.after the investigation the determination will be made to file or not file a case.if the police refuses ti file the case the victim has the right to take the case to the da's office. if the da's refuses to prosecute then you have to seek other rememdies.i know you wanted an answer but it just is not that simple.

21.11. Indecency With a Child
(a) A person commits an offense if, with a child younger than 17 years and not the person's spouse, whether the child is of the same or opposite sex, the person:

Sexual assault is a felony of the second degree. The offense becomes aggravated assault when the
child is younger than 14 years of age, in which case it is a felony of the first degree.

A person who has committed any of the acts outlined above has positive grounds for a defense if that
person is less than three years older than the victim, the victim is over 14 years of age, and no force
was threatened or employed against the victim.

All I know right now, is the kid was arrested, taken to jail, spent a week at juvenile hall, was sent home on house arrest. He is allowed to go to school at an AEP facility where he will stay until the trial. He is not going to be allowed back in the public school the rest of this year.
