Very highly doubt it...simple reasoning really...
If he did commit rape/sexual assault, I personally don't believe he would have came out immediately afterwards and admitted having consentual sex with the woman.
Rape/sexual assault is a 2 part case to prove:
1) Sex occurred---oftentimes difficult without a rape/semen kit
2) Sex was/was not consentual---this relies more on the woman's credibility than the man's. Any wavering by the woman often swings the verdict to the accused advantage...ie..."well, at first I wanted to, but after 10 minutes of intercourse I changed my mind and said 'no'"...
Legally if the man did not stop, that constitutes rape...but trying to sway a mixed gender jury to find the man guilty without a reasonable doubt is at best improbable, mostly impossible...

My opinion ? I think she wanted it, to have a go with an NBA superstar future legend. I think right after the clothes came off she might have literally gotten more than she bargained for and tried to get out of the whole thing. I think Kobe forced the issue (NBA players don't get told no often I imagine) and she probably did say no, and he said uh huh, whatever.
Rape ? Sexual assault ? We'll probably never know. As the law is written (as I understand it) when the gal says no everything must stop and right there. I beleive that it didn't in Kobe's case and there should be punishment. Prison time ? I dunno about that, he's led a model life, never an indication of a criminal mind ... I just think everything needs to be taken into account.
How did he ask?? Did he mentally persuade her to walk up to the 2nd floor to his room and walk in?? I think it happened pretty close to what Stealty said.

She said no ... I'm betting she did but after they started being naughty. Should that be a factor ? I think so. Should it release him from guilt ? No. Should a up til now model citizen, NBA role model and icon be sent to prison and virtually lose everything he's worked so hard in life to gain, because he didn't stop the very second the chick who came to his room and who willingly made out with him said the word no ?
