Default Laws: Made to be un-made

I was watching TV last night and this guy in Texas was rasing hell because his son was 'raped' by some gay men and since sodomy isn't illegal anymore, if his attackers are caught they face very little time in jail.
So the show went on about how the homo's got the supreme court to de-criminalize sodomy sometime back in July, 2003. (Anyone know if this is nationwide or if it just applys to Texas and Montana as they were the only 2 states this show mentioned.)

My thoughts were this:
This world is going to hell in a hand basket.
Why in the world arn't same sex rape cases considered as serious as a "normal" rape case?

I think that now they are considered the same thing, that is what he is pissed about. There is a case that I've seen on the drudge report that is a guy bitching since he got something like 17 years for raping a boy, when if he raped a girl it would have been 5 years. My facts might be a bit off, but not much I don't think.

I heard about that on the radio last week. If I remember correctly, the maximum sentence would've been five years for raping a girl, but theoretically he could've plea-bargained for even less.
