Default fetal theft - double murder ????

HOLDENVILLE, Oklahoma (AP) -- A missing pregnant woman was found dead in a field with her abdomen cut open and the fetus removed, and a 37-year-old woman was in custody after bringing a dead fetus to a hospital.

A hunter found the body of Carolyn Simpson, 21, of Okemah in a field near Lamar, about 100 miles southeast of Oklahoma City, on Friday. She had been shot in the head, said Tommy Graham, an Oklahoma State Bureau of Investigation regional inspector.

Simpson was six months pregnant when she was last seen December 22 at a tribal casino in Okemah where she worked. One day after Simpson's disappearance, Effie Goodson brought a dead fetus that had reached six months' gestation to a hospital about 30 miles from Okemah, saying she was the mother, authorities said.

Medical personnel determined Goodson couldn't have given birth to the fetus, and the 37-year-old was taken into custody as a material witness in connection with Simpson's disappearance. Graham said he expected she would be charged this week.

Officials hadn't determined whether the fetus brought to the hospital was Simpson's, Graham said.




How could it be a dead fetus if it was never a living fetus ? Interesting choice of words, isn't it ?

NY Bowhunter - I suspect the woman is mentally ill and murdered the pregnant woman and took her baby. As brutal as it sounds its happened before.

But now what ? She can be charged for certain for one murder, but what about the fetus ? If it was "dead" then it was "alive" at one point - right ? Did seh committ double murder then ?

I would say yes. At some point in the pregnancy it is considered alive. I'm not sure what stage that is, nor ever understood that. But, I think she'd have to be guilty of double homicide. Brings me to another question. A different twist to that story. At what stage in the pregnancy would it be considered not murder? Isn't there a point where the fetus is considered alive? I may be wrong on that, but if I'm correct that's a lil weird in a case like that. Say the woman was 2 weeks pregnant and the sicko killed her. Does she get double homicide? The baby wasn't classified as alive yet, but more than likely would have been at some point.

It is a double murder. The mother was a living human and was killed....the fetus was a living fetus (human) and was killed, becoming a dead fetus (human). This seems clear to me.....perhaps only to me.
If the fetus was not living while in the mothers body is it possible that other tissues of human composition may be considered to be "not living" while contained within the body? How about brains? Or maybe only some folks brains are not alive while in their bodies???
Does a person need to have a Social Security # issued to be considered living?

Murder or theft?

This should be a good one in court. Everyone has there opinion on when life begins but the only one that really maters is the legal one. This has nothing to do with religion and everything to do with politics.

IMO it's double murder. Pregnancy is the begining of life in the womb. All life is precious from 1 day of gestation to 80 years old. To end a human life is murder!

farmcntry - Can you prove that point of view ? Legally that woman who was murdered could have aborted that fetus, no questions asked. How then could the woman who "killed" it and her both be tried for double murder ?
