Prairie View A&M University found new jobs of equal value for blacks laid off last year but failed to do the same for dismissed white workers, federal employment regulators have found.
According to confidential Equal Employment Opportunity Commission documents, the historically black university moved James E. Mackin, a former dean, to a job of lesser value and removed Robert W. Burns from his job working on a juvenile crime program in the president's office.
The agency also determined the school retaliated against Mackin when he complained about the alleged discrimination.
Bob Wright, director of communications for Texas A&M System in College Station, said he could not comment because the cases involve personnel matters and pending litigation.
The EEOC will refer the cases to the Justice Department in a few days, said Mark G. Lazarz, an employment lawyer at Shellist, Lore & Lazarz in Houston, which represents Mackin and Burns.
Jim Sacher, acting district director of the EEOC in Houston, declined to comment on the cases.
When the cases are referred to the Justice Department, its Civil Rights Division will determine if federal action is warranted, said Jorge Martinez, a department spokesman.
In May 2002, a week after Prairie View President Charles Hines resigned, Mackin said, he received a letter saying his job as dean had never existed officially and his job as a special assistant would end in four months.
Mackin complained to the EEOC that July, and a week later he was transferred to the chemistry department as a tenured professor, a nine-month position instead of a 12-month post. His annual salary dropped from $99,000 to $75,000.
There were other slights, he said, including his being given only a three-day notice to move his office.
Mackin left Prairie View in August 2003, saying the university made it unbearable to stay. He is now an associate provost at a small public university near Atlanta.

Where do you think all of the liberal crap such as afirmative discrimination comes from other than the utopias of public universities? I have a hard time feeling any sympathy for an employee of a public university who is harmed by its liberal policies.
