BOSTON, Massachusetts (Reuters) -- The highest court in Massachusetts ruled Tuesday it is unconstitutional for the state to deny marriage to gay and lesbian couples, a move that could make the state the first to legalize same-sex marriages.

In a ruling posted on its Web site, the Supreme Judicial Court said the state of Massachusetts may not " deny the protections, benefits and obligations conferred by civil marriage to two individuals of the same sex who wish to marry."

The lawsuit Goodridge v. Department of Public Health was brought by several gay and lesbian couples seeking the right to marry in Massachusetts.

Gay marriages are forbidden in the United States, although one state, Vermont, allows same-sex civil unions.

Earlier this year the U.S. Supreme Court overturned state sodomy laws, a move some conservatives said could open the door to gay marriage.

That decision and Canadian steps taken to legalize gay marriages earlier this year have intensified the debate.

First, I' d like to say upfront that I don' t think the government has any bussiness in the marriage business. To me, it' s a church thing. That said, since a vast number of marriages are a " government" marriage, I think that gays should be allowed to be married. If it' s a government thing, then you can' t discrimiate against someone.

That is the crux of the matter 1eyed! The government does in fact mandate morality all the time.

I cannot marry my mother, my sister, my daughter, my dog or a sheep.
Why? Because it is MORALLY wrong.

If they actually issue these fruitcakes " marriage" licenses or anything of the sort, I then want to marry my sheep. We kill millions of them a day so " permission by the sheep" is no longer an issue.

This ties in very neatly with my prior posts regarding health insurance. The *****s claim it' s for property and benefits rights ... well, get rid of employer sponsored bennies and they have NO LEG to stand on. (re: property, they can get wills).

Justice Spina, in a separately filed dissenting opinion, stated that " [W]hat is at stake in this case is not the unequal treat..nt of individuals or whether individuals rights have been impermissibly burdened, but the power of the Legislature to effectuate social change without interference from the courts, pursuant to art. 30 of the Massachusetts Declaration of Rights." He emphasized that the " power to regulate marriage lies with the Legislature, not with the judiciary."
