Cops are sworn to a duty to protect. What the decision means is that you can't sue the cops if they don't protect you.

Duty has a somewhat different definition in law, close but a little different.

Yep, that's why you should always bring you friends Smith and Wesson with you when you go out in public.

We read the news article. Apparently the city is warning the cop that he won't be eligible for workers comp if he gets sick as a result of trying to revive a ten-year old kid.

My husband says that he could name a half dozen attorneys here who would be happy to represent a cop, pro bono, in a case like that.

He's certain that you could find at least that many there. Even a rookie lawyer would have no problem making the city attorney look like evil, bloodsucking, vermin to a jury.

Not to rag on police but to emphasize the importance of understanding that when it comes to protecting yourself . . . you are truly on your own: your safety and the safety of your family is in your own hands. The way that this point has come up -- that the police aren't liable -- is because they were sued, unsuccessfully, for having received a plurality of 911 calls from a woman in Washington DC (am I wrong and was it Philadelphia?) who reported being assaulted in her home over a period of some 10 hours or more. The police never came to help her out. She ultimately was killed by the perpetrator. So . . . if you can't wait at least 24 hours to get protection . . . have a gun and know how to use it.
