Default Elena Kagan.....

....should she recuse herself ? She cannot be MADE to recuse; recusal is done as a matter of integrity. Kagan is a liberal. Being one, she is a vile and disgusting scumbag who, by definition, has no principles other than the furtherance of socialism. She has no integrity. Our Porcine Praetor has demonstrated her prejudicial attitudes towards Obamacare on many occasions and many feel she should recuse herself. Others feel that she committed perjury during her confirmation hearings by stating she had no opinions regarding up and coming legislation which appears to be a bald-faced lie given her activities to promote and advise on the presentation of obamacare. This pig should be impeached....unfortunately, a new administration would need to be in power for that to happen. I wonder if the finer points of constitutional definition would allow a sitting president to ask congress for articles of impeachment for a sitting Supreme Court justice ? Would a first impeachment of a sitting SCOTUS judge since Samuel Chase (1805) invalidate opinions ruled upon by her ? All of 'em or just the ones she was found to have ruled on , improperly/illegally ? Provided she was subsequently removed, of course....

What would be the rationale for her to recuse herself? Typically judges recuse themselves if they have a business interest in which way a decision turns, if they were involved in some way in passing the law they are scrutinizing. Is the sole rationale for Kagan to recuse herself that she wrote an email in which she expressed a personal opinion about the passage of Obamacare? If that is all that is involved, I don't see the rationale for her to recuse herself. Judges, like the rest of us, have opinions on public issues. That alone is not a basis to recuse. Maybe there is something else involved that I'm not aware of.

I'm conservative and would much like to see Obamacare ruled unconstitutional -- on the basis of the unconstitutional mandate requiring indivuduals to purchase healthcare.

I believe it has to do with the fact that the email she issued, and some other communications from her, indicate her total support for the initiative. Her stint as U.S.Solicitor General included defending the healthcare initiative so distasteful to many millions of Americans. That would indicate a pre-disposition towards a decision before any evidence is heard. Also, the fact that she testified under oath before congress that she had never had anything to do with Obamacare when she was up to it up to her elbows constitutes, in the eyes of some, to be perjury. Certainly, I do not feel comfortable having a judge sit and make decisions on matters that are not going to be handled impartially, and for which attitudes have beeen publicly claimed prior to hearing evidence. We should not have to CONVINCE a judge...just present the facts and allow them to evaluate the case brought before them according to constitutional guidelines. According to 28 USC 455, Supreme Court justices must recuse themselves from “any proceeding in which his impartiality might reasonably be questioned.”

Thank you wise woman....I had been looking for a legal reference but my work-addled faculties just would not kick in. The entire value of a judge is their impartiality. This hereford is anything BUT impartial....

That is a very impressive example of a hereford. Kegan is in no way, shape, form, or fashion anywhere near that impressive...a big insult to the cow....physically and probably mentally as well. I'd bet that cow doesn't try to breed with other cows...

I know....THAT cow is beautiful and a very fine specimen....the cow currently sitting on the SCOTUS is a bovine embarrassment to humans and cows alike.
