I am not sure how this is a murder charge, manslaughter yes, but murder? I do not think so. It sounds like the 10 year old just did not know what to do when the kid started crying. It is easy to snap when kids start crying!

She needs to be pit to death. By age of 8 you understand reasoning so by 10 she knew she was committing murder and deserves death. An eye for an eye.

Did this 10 year old act on her own instinct, or was she taught this behavior? Seems like theirs a lot of anger in this child.

I don't know the elements of "third degree murder" in Pennsylvania, but a charge involving the death penalty would require intent. It would be impossible to show intent here.
Most 9yr olds don't understand life and death at that age. Nor do they really understand right and wrong.
The sitter will spend (hopefully) several years in prison for what has happened.
The little girl, should spend several years in counseling. Along with "supervised" probation, to further determine if she understands what happened, and that IF she was responsible for this death she will spend time in juvenile lockup.
I taught school for almost 30 years and I have seen a lot. Adolesent children that show this type of aggression are not criminals. Children act out this type of behavior by being treated in same manor. The adults in this childs life are the biggest problem. Let's not even talk or think of the death penalty in this type of case involving a 9 or 10 year old child. Let's let the law enforcement and child protection agency do their work before we make any kind of judgement. Remember OTo. Jim
The article says her case has been transferred to juvenile court which certainly rules out any death penalty, and probably prison time also, as it should be.
I'm sure her attorney will demand an extensive psych evaluation. She'll likely wind up spending time in a treatment facility for children. It's a terrible thing for a child that age to have to deal with. I'm certain she was not aware that she was injuring the child to that extent.
