Default Lady Justice really is Blind!

Wikipedia: The Ninth Circuit had long been instrumental in striking new legal ground, particularly in the areas of immigration law and prisoner rights.

Sixteen to one not considered self defense unless they are armed; restitution must be made (pain and suffering) regardless of trespassing, property damage or being in the country illegally.

Have we really reached the point that the so called justice is granted to those that break the law in the name of political correctness or have we reached the point that it is time for the old west justice to be the new law of the land. I am tired of being silent while being treated as a second class citizen in the name of political correctness. I’m surprised no one else has posted this!

Lady Justice may be blind, but some judges are consummately stupid. When you're outnumbered 16 to 1 by an adversary or potential adversary who might use their numbers to overpower you, you flex all the muscle you have with you. I'd like to see "the court" face those odds under the same circumstances and see what happens. It just makes me sick.

What do you expect from the court that has the most overturned verdicts in the Supreme Court.

Someone made that statement the other day. Not true. A quote from the other thread (cited from foxnews):

Quote:
Though the Supreme Court is occasionally at odds with the 9th Court, the latest string of decisions is out of the ordinary. Judicial statistics kept by SCOTUSblog show that 9th Circuit decisions actually have a better-than-average showing before the Supreme Court. In the last session, 27 percent of its rulings were affirmed, while 60 percent were reversed. For all circuits, the reversal rate was 71 percent.

That being said, the verdict against that rancher is outrageous.

Cool

I don't think it reflects very well on the quality of Appeals Court decisions if they get reversed 60-71% of the time.

And it doesn't reflect well on the quality of legal education in this country since most of those opinions are researched and essentially written by clerks not long out of school.

For gross injustice, this one ranks right up there with the prosecution of Border Patrol agents Ramos and Campion.

The "Bind Lady Justice" is meant to be a good thing. It symbolizes impartiality. For a proper analogy, you should perhaps say, Lady Justice is peeking.

Those statistics are probably a little misleading. I think the reversal rate is calculated based on the percentage of cases heard by the Supreme Court. The vast majority of cases are not taken up by the Supreme Court, effectively making them affirmed. For SCOTUS to take the case, it is normally because they feel a decision was incorrect, there is a disagreement of law between circuits, or there is some new or novel concept of law without a lot of precident to draw upon.

Well, based on this, I'd say "Lady Justice got hit in the head with a swing at the playground when she was a kid"

I can't say I'm particularly pleased with where our justice system currently sits. But I can't say I'm surprised.

I disagree with criminals having fairly expansive rights, and remedies in both civil and criminal courts. The liberals and the idealists in this country would prefer to neuter law enforcement and law abiding citizens in favor of criminals. They want to avoid any form of what they see as violence or threats of violence, even if it benefits the criminal.
