I assume this appeal will be appealed. So stupid. I would assume that the law defines "residency" and Emanual either meets or does not meet that definition. It is amazing that different judges can't read a law and decide what it means with any consistency.

That's the point. And judges do differ. I have the appellate opinion on my desk in front of me and what others failed to tell you is that Rahm was ruled against 2 to 1 on the panel.

So, the question goes to the state supreme court. Just like those in the armed forces are still resident of the city for voting purposes, I think Rahm was a resident for the purpose of running for mayor.

If you wanna get technical and legalistic.

I think the panel was correct. He's a resident for purposes of voting, but not running for office. There are two different standards in the statute.

I guess everyone also failed to mention that the case is in the appellate court because Rahm won at the agency and circuit court level. But now they crow about him losing?

Whoa, didn't Rahm last year file his tax return to a different state? I think he did which means he gave up residency. Military folks under deployment still file returns in there home state to an address of residency.
