Default McCain's 6,000 National Guard Mandate in Trouble

Committee Chairman Carl Levin, D-MI, told reporters Friday that he thinks the measure is unconstitutional, and said he received a letter from Gen. Jim Jones, Obama's National Security Adviser, "strongly opposing that language."
Levin predicted the McCain amendment would be quashed either on the Senate floor or in negotiations with the House over the defense bill.

"I believe that this would be an issue on the floor as to whether or not the Congress has the authority to direct troops to go to specific locations. There's no precedent for that, according to the Library of Congress. We can add, we can recommend, we can fund, we can prohibit, but can you direct the commander in chief to send troops to a specific place? There's no precedent for it," Levin said.
Levin added that "we'll be hearing from the President, I assume, or his security adviser again on this," predicting a tough fight on the Senate floor over whether or not to strike the provision from the bill.
Still, the bipartisan vote in committee on Thursday could make it difficult to strip the provision during floor debate, leaving what could be seen as a highly controversial decision to House-Senate negotiators.
Ok, but he leaves out they have the Constitutional authority to declare war.

Can they get any more ass backwards?

One of the few powers that the constitution gives the federal government is to...

establish a uniform Rule of Naturalization, which the SC has held that this also includes the power to regulate immigration.

and to provide for calling forth the Militia to execute the Laws of the Union, suppress Insurrections and repel Invasions
Is the National guard not part of the militia? Are we not being invaded?

They call constitutional authority unconstitutional....... and in their other hand they are cramming every actual unconstitutional bill down the American citizens throats.

My God can I get any more frustrated with these idiots?

Amen, how many Dems do we have on tape saying they don't know or don't worry about the constitution? It only matters when they don't get their way.

Now you WANT the Congress comprised of a Democratic majority, with which you have much disdain..to broaden their powers. Congress doesn't have that "Constitutional authority". Honestly, if any of those items you stated were "actually" occurring, the Govenor would have the power to activate, if I'm not mistaken, not sit and wait for John McCain to run something thru for his own flip flop on amnesty.

Hello, there is no broadening of powers. Congress already has the constitutional authority and power to control immigration and to call the national guard to enforce immigration laws if needed. I WANT congress to do their damn job, regardless of party.

congress can't activate the National Guard or end them anywhere??? During the '67 riots in Detroit Governor George Romney activated the National Guard w/o the Feds approval, to quell the uprising that you were describing in your post....So if they are being invaded, which is what you suggest, than the Guv can, same w/ insurrection
