Col. Barfoot, a WWII Medal of Of Honor recipient has been ordered to remove his flag and flagpole by the local homeowner's assocoiation. This man has done more for this country in three wars than all the idiots of hoa put together. The members of the hoa board need to be lined up and beaten with golf clubs.
For conspicuous gallantry and intrepidity at the risk of life above and beyond the call of duty on 23 May 1944, near Carano, Italy. With his platoon heavily engaged during an assault against forces well entrenched on commanding ground, 2d Lt. Barfoot (then Tech. Sgt.) moved off alone upon the enemy left flank. He crawled to the proximity of 1 machinegun nest and made a direct hit on it with a hand grenade, killing 2 and wounding 3 Germans. He continued along the German defense line to another machinegun emplacement, and with his tommygun killed 2 and captured 3 soldiers. Members of another enemy machinegun crew then abandoned their position and gave themselves up to Sgt. Barfoot. Leaving the prisoners for his support squad to pick up, he proceeded to mop up positions in the immediate area, capturing more prisoners and bringing his total count to 17. Later that day, after he had reorganized his men and consolidated the newly captured ground, the enemy launched a fierce armored counterattack directly at his platoon positions. Securing a bazooka, Sgt. Barfoot took up an exposed position directly in front of 3 advancing Mark VI tanks. From a distance of 75 yards his first shot destroyed the track of the leading tank, effectively disabling it, while the other 2 changed direction toward the flank. As the crew of the disabled tank dismounted, Sgt. Barfoot killed 3 of them with his tommygun. He continued onward into enemy terrain and destroyed a recently abandoned German fieldpiece with a demolition charge placed in the breech. While returning to his platoon position, Sgt. Barfoot, though greatly fatigued by his Herculean efforts, assisted 2 of his seriously wounded men 1,700 yards to a position of safety. Sgt. Barfoot's extraordinary heroism, demonstration of magnificent valor, and aggressive determination in the face of pointblank fire are a perpetual inspiration to his fellow soldiers.

If the HOA agreement doesn't specify that flag poles are disallowed they don't have a legal leg to stand on in court, they're just trying to wear him down, any competant lawyer could spank them. I think it sucks personally, and the board of his HOA should be flogged. One of the many reasons I live in a rural area is that I have vastly less a-holes trying to tell me what to do. Screw HOAs and the horse they rode in on.

What a sad sorry lot when they are going to harrass a man who fought for their sorry butts so they could put thier organization together even. I would add at least one more pole with a POW MIA flag or something just because I could.

Like it or not, part of purchasing a property in a homeowners' association is agreeing to play by the HOA's rules. People do it because they want to have everyone else play by the rules, and they don't want neighbors to erect things that detract from the value of their property.
That an American flag is being flown is not the legal issue. Neither is his military service. That a flagpole was erected after the request was denied by the HOA is the issue. If he doesn't like the rules, he can take legal action or move where he is allowed to erect a flagpole of his desired dimensions and fly his flag.

The way I understand it (as quoted above) is that there are no such restrictions on flag poles in this neighborhood so I don't see where he is breaking any HOA rules.

There are tons of properties still today with CCR's that exclude blacks, jews and other things and groups. They have to be legal and reasonable to be enforceable and although the flag would probably be a free speech issue it's size or the size or type of pole could be an issue. Maybe the HOA are the same folks who banished "Christmas" in my area, ....... probably V.C. sympathizing commies!!

I agree, if his HOA doesn't say anything about a pole than it should stay. I am careful when I read these stories. Just last year my favorite bar was all over the US news for throwing a biker out because he had a US flag on his jacket. The story killed the bar, protestors from all over the US. Email totally full. I know the owners and the real story was that he has a sign behind the bar that states, bikers are welcome but no gang leather jackets showing their gang and colors. We have another bar just up the road where all the bikers hang out. No family would ever go there and it is a brand new place, just taken over by the bikers now. The owner was just making sure it didn't happen to his place and the story was twisted into a US flag story by some bumb.
I on the other hand really like how strict my HOA is. That is why I moved to where I now live. Had a great house with an inground pool and great outdoor setup then some Ahole Hick moved in around the corner, started selling cars in his yard, doing engine work in his driveway and had a fridge outside the house on the driveway. We intentionally sold that house over the summer when buyers couldn't see what happens. Zoning is great, buy it if you want, if not, go live somewhere where you don't care if some Ahole ruins what you have.
