Default Empathy Now and Empathy Before

Old Tom Coburn out of OK sure has a problem with the present nominee and any type of 'judicial empathy'. He didn't use to.:

"At the Sotomayor confirmation yesterday, Senator Tom Coburn was concerned about Judge Sotomayor's Latina pride affecting her decisions:

"Your assertion that ethnicity and gender will make someone a better judge, I'm not sure that that can be factually correct." He was worried about the President's empathy standard:
"He stated that the tough cases can only be determined on the basis of one's deepest values and depth and breadths of one's empathy. I believe that standard is antithetical to the proper role of a judge."


So now let's go back in time to 2006 -- the confirmation hearing for Justice Samuel Alito -- when Senator Coburn asked this question:


"Can you comment just about Sam Alito and let us see a little bit of your heart and what's important to you in life?"
Prompting Judge Alito to talk about his Italian heritage, and its effect on how he sees immigration cases:
"When I look at those cases I have to say to myself, and I do say to myself, you know, this could be your grandfather, this could be your grandmother."
And in discrimination cases:
"I have to think about people in my own family who suffer discrimination because of their ethnic background or because of religion or because of gender."
And in disability cases:
"I have to think about people who I've known and admire very greatly who have had disabilities."


Judge Alito was positively steeped in empathy -- and back in 2006, that was fine."

If he'd said something racist like "A wise Italian man in the richness of his wisdom should always come to a better decision than a Latina woman", he would have never been confirmed. If he'd said that no less than six times, he would have never been considered to begin with.

But has he ruled purely on ethnicity as Soto has? Favoring minorities over whites, as in the Ricci case? I think not!
She's proven to be a raciest. You seem to use the race card a lot from reading your post. But then again most of your racial statements are one sided.

Obviously distinguishable... Justice Alito never said that, because of his background, he believed he'd render better decisions than a [insert racial description here]...

He didn't say "I'm Italian, therefore I'll be a better judge than a Black man, or a ***anese woman, or a Hispanic regardless of gender..."

There was a trial judge and two others on the panel who ruled with Sotomayor before it got to SCOTUS. Also, the case was dismissed by the trial judge -- this was overturned by SCOTUS. The question was how the city should act because it was afraid of liability.

But you go ahead and play the white victims' card.

Beau,
Point to any specific Alito case where his Italian heritage helped guide him to a decision, and you may have a valid point. I think that you have a better chance of getting justice as opposed to empathy standing in front of Alito. Thinking empathy even plays a part should be a dis qualifier, and points to the ineptness (lawlessness) of the President who thought it was important.

Dang......there's a book (I can't think of the name) that highlights liberal tactics. One is what we see displayed here: require the opponent to stick to their rulebook, but don't stick to your own (or don't have one).

simply put, this puerca is a racist, regardless of who acknowledges or denies it. Being an idiot, and in the richness of my EYE-talyun experience, I would ALWAYS render a saner, wiser, and more equitable decision than that slob of a lying obama hack.

But the Obama-droids WANTED this...I can't wait to see what destructive trash she will make policy on...because her decisions will affect each and every single one of us. Hopefully, first blood will be drawn from the LEFT side of the aisle where the stupidity runs hot and thick.

She is anti gun. End of consideration to me right there. She will be confirmed and in the end, we will pay a awful price for it. (gun owners) Liberal worm.
