Default SCOTUS Decision On Criminal Use Of Gun

The guy was doing an armed robbery and claimed that the gun went off accidently.No one was hit by the bullet; the perp was given an extra 10 years for discharging a firearm while committing a felony. The appeals court ruled against the felon and the SCOTUS upheld the sentence 7-2. This guy will be in prison for a long time.

There was asplit between the 3rd and the 11th AppealsCourts on this issue:That is now resolved.

The penalty for any level of crime involving illegal drugs should be just as harsh if not much worse.

Most states allow for more strict sentences any time a gun is used in a crime, often whether it is discharged or not, some even allow the same penalties when toy guns are brandished if they appear real. It's a simple choice, get a real job or be prepared to do time.

I hear of many crimes/punishments that I'm sympathetic to, this is not one of them. A guy committing a robbery with a loaded gun and it goes off accidentally? that's no accident whether or not he intended for it to go off.


A year or two back I heard about a gang banger who "accidentally" shot a child during a drive by, and because he was convicted of a child murder, he was places on the sex offender registry. They had him on tv basically saying, I'm not a sex offender etc...which ya he wasn't a sex offender, personally I'd rather know of a child murderer or even any murderer living next to me than some teenage guy who hookd up with his underage girlf and is now a sex offender.

Most of the scumbags on the sex offender registry are not guys who had sex with an underage girl. Many of the scumbags raped little kids. This is the OK sex offender registryfor my area code.

He had the gun. He had planed on using it, either to shot someone who did not comply, or to make them comply. Either way, he had to intend on using it. Throw him in the can and let him rot.
