This is a training issue. The 25-year-old obviously not going to answer their question that could potentially incriminate him and he is detained and not free to go. He didn't ask for an attorney but he is in a situation where a Miranda warning would apply and any answers gleaned from him could be ruled inadmissible as fruits of the poisonous tree. I'm surprised Judge Napolitano missed that.

This type of thing is caused by the Bush/ Cheney initiative to stop TERROR, this guy is very lucky that they didn't take that money and send him to Guantanamo. The arrogance and attitude of these officials is created by the TERROR initiative.

People being suspect for carrying large amounts of cash is nothing new. Neither is the issue of some police abusing their authority by taking the money.There was a story done in Lousiana back in the early-mid 1990s about police who were pretty much confiscating any large amounts ofcash found amongpeople the stopped. Even when they were caught redhanded, not much was done. Very easy to make the case that something is somehow drug money and then the victim has one hell of a time getting it back, ifthey ever do. It is something that cuts across administrations.

Lanse, That happened to a friend of mine in a western state about 15 years ago, he was stopped and had just under $10,000 on him took him about a year to get about half of it back.

I noticed the TSA used the old "if you got nothing to hide" line heard that alot on this site when the Patriot act was signed.

$4700 isn't pass the threshold that is set for detainment. Heck, I've had that much in the past before so I don't know what's the big deal. It's TSA trying to feel important. However,I understand 10k is the threshold when they can detain you. Perhaps ipsc can shed some light.
