Default What is your take on this?

I am friends with a lady at church whose step daughter went to a bar in Mankato MN.on her 21st Birthday and drank herself to death. Her name is Amanda Jax, and she was struggling with anorexia so she was deadly skinny. Now her family is trying to sue her friends and the bar. Being I know her dad and step-mom I am almost positive they aren't the ones filing the lawsuit.

I think it is wrong and would be upset at Ken and Patty if it were them. What ever happened to personal responsability? I don't think the friends are at fault any more than her because her friends were all drinking too. I also don't think you canhold the bar responsible becausehow do they keep track of how many drinks you have and how many you can handle. It's not like you walk into a bar andstep on ascale so they can determine how much you can drink and then stamp your hand for every time you have a drink.

What's your take is it right to sue or not and why?

the only way the bar can be held accountable is if they served her when she was already intoxicated..as in came in drunk or they didnt cut her off from drinking any more alcohol if she showed signs of being intoxicated...then it can fall back on the waitress/bartender then the bar itself....but if she drank and didnt look or actintoxicated thenwent home and died be it in her sleep or other wise it would be hard to go after the bar.......
its called the DRAM SHOP LAW..

My Wife has worked/managed bars for 26 years and I managed/worked in bars for 10 years we pay insurance for this type of deal..

I called my wife and she heard someone had died in MN........It must be the same person being how she couldnt place it in Fargo/Moorhead......

Being I wasn't there I can't say for sure whether they served her when she was intoxicated but I have been to bars before and know that it is custom for your friends to buy you rounds when it's your b-day so there is a good chance that the bar tender or waitress had no idea how much she had.

She went home from the bar to an apartment in Mankato with her friends and when they went to wake her up the next day she was dead. Somehow they girls made it home and who knows if they drank more liquor when they got home?

Theres the catch......If the bar had vidio and it showed her in a drunken stage it can be held against them but if it dosnt then it comes down to the people around her at the time....
When a 21 comes in we pay really close attenchen to the group and we wount let the 21 shot deal happen.....
We have had people come in and stumble thru thier money,stager,talk with a slur ask what kind of beer or whisky we have,these are all BIG RED FLAGS.....some are the police testing and other are just drunk...We wont serve water or coffee or pop to these type of people due to the fact it can come back to you being the last to serve.DRAM SHOP LAW..I know it sounds extreme but its just to save face...
Being in the bar biz is very tuff these days......

yea, it's rediculous these types of suits happen, just the fact that they are allowed to go to court can cost the parties thousands of dollars. In situations like this, people need to be responsible for themselves.
