Default Lawyer types, help me out

Since more of you are law savvy here, what if anything can I do. I posted this in the offseason but think it might get more responses here.

I skimmed through the Texas Penal Code and didn't find anything. I doubt it would be illegal merely to display a photo online, particularly if this guy acquired it legally in the first place. Although if you can prove you own the photo and hold its copyright (which you do if you're the one who took and published it), you might be able to get a cease anddesist order against its display. NT would probably know what to do.

If you didnt personally takethe picture then it probably will boil down to a copywrite issue.If it was for school you probably already signed something saying the school could take the picture and use it.

But copywrite laws are very srange anyway concerning things like this.Last year Walmart wouldnt let me duplicate pics of my own kids because they looked like they were "professionaly" taken.If someone besides the photographer shared the photos with a felon it could well be illegal, but the guy that took itwould have to press charges, not you.

Have you tried contacting myspace? Consult an attorney to find out any additional alternatives but if myspace will take care of the problem, that's free.

Myspace was the first person I contacted. I also talked to local authorities and they gave me a web site of the F.B.I. to file a report with. I have done that as well. Ill be talking to my lawyer today. I dought anything can be done, but im going to try to have a peace bond placed on the person who took the pictures. They are a student of the school and a memeber of the yearbook staff (or was). Im going to try to get this peace bond because I do not want this idividual to be around my kids. The know felon in this case is my kids biological mother, who has a peace bond agianst her. She can not get within 200 feet of my kids. The student who did this is consorting with the felons half brother to get things to the felon, which has also turned into harassment of us via the internet by another of the felons friends. I have filed a complaint about all that as well. I guess Ill know more this afternoon.

That does complicate things a little. The school should be taking some action on their own in this matter.

Thanks everyone. My lawyers are on it. It does not look good for the known felon (when I sent the info to the authorities, we found out she has two out standing warrants and all the contacts that have been traced has lead the law to the felon) , as for the young lady, my lawyers dont really have anything on her, but are going to contact her with a cease and desist letter. Ive filed a report with the D.A., C.P.S. and the FBI, since this was done over the internet. I was advised bymy lawyers to do so.Now it is all documented and files started. If theyget out of line agian, we can goafter them will all the dogs.
