Seems like the Health Department tossed the Constitution into the waste incinerator. Unless this man demonstrates a deliberate criminal attempt to sicken other people, he has not violated the law, and it is his right to move freely and enjoy life as he pleases.
Bet that this guy was prescribed TB meds and then quit taking them after awhile. This is how TB became so resistant in the first place:Saw adocumentary on this on TV a couple of years ago. A nurse lay dying in a Baltimore hospital because shequit taking her Anti-TB meds and when she startedher drugs againit was so resistant that nothing would work.
An aunt of mine died of TB in 1929. Her sister also lost a lung to TB.
Now are they issuing him marijuana for his "pain" and letting him drink lots of liquor, eat well and get all the sports channels? This could be a setup on his part you know.

Ever hear of the Fourth Amendment? I think the Eighth might've taken a blow as well in this case. The public doesn't have a right not to come in contact with TB. They don't have a right to tell people who to treat their illnesses. Quarantining this guy against his will, on the other hand,is a violation of his rights! Maybe this is how they do things at the county level, but wait until it makes its way up the ladder.
What if he had Ebola instead Aught? Would that be different? Should ebola victims, who could easily decimate our population, be segregated against their will for public safety? The TB was curable until he took the responsibility of not correctly following his prescribed course of treatment, a willful and dangerous act on his part. Peoplw who know they have AIDS and spread it out of spite are very often locked up for doing so, and should be. Spock was right this one time, sometimes the needs of the many do outweigh the needs of the few, or the one.

it's definitely an interesting question. back in the early days of the aids scare, (and several careers ago) i did a fair amount of research on the potential for quarantine of aids sufferers. i found the vast majority of case law from the early to mid 20th century supported forcible quarantine of those with contagious TB, so long as due process was accorded.

Bet you would change your mind if a loved one of yours caught TB from the guy.
