Associated Press, Manchester, NH - Police say a man they pulled over for driving drunk continued to swig his beer during his arrest. Patrick Allain, 35, faces numerous charges after his arrest Monday night, the fourth time he's been arrested for driving while intoxicated. Police say he hit two other cars and initially refused to stop when officers tried to pull him over.
When he finally stopped, Allain allegedly continued to drink a 40-ounce bottle of beer, telling officers, "You can charge me with whatever you want. It's not going to stop me from drinking and driving."

Charge him with DUI, reckless driving, and multiple counts of felony reckless endangerment (drivers captured on the police cruiser's dash cam, pedestrian witnesses, etc.), and impound and auction his car while you're at it. What a worthless human being.
I would think that there are laws on the books in N.H. that would put him in prison for a few years, if the judge has the nads to enforce them. The local people and the press need to get behind this and insist on justice.
Old trick so your lawyer can say the high alcohol count was after the stop.
If he was drinking while sitting in the driver's seat with the keys in the ignition, he was by definition operating the vehicle, regardless of whether he was parked on the shoulder.
Someone needs to throw the book at him. And then get another one off the shelf and throw that too.

"In the old days" a guy wrecked his car and someone called the police. When the sirens approached the guy, who was out of the car, got out a pint of vodka and chugged it in front of all the people present saying he needed it to settle his nerves. When the police arrived they determined that he was drunk and proceeded to process him. Rumor has it that the state lost the case because he had witnesses that stated he was seen drinking after the accident but before he was checked by police. The state couldn't prove he had consumed more than the legal limit while driving. They could only prove his BAC after the police arrived and it was on record that he consumed alcohol after he ended his driving. Loop hole that worked at least once.

the sad truth of our judicial system is - they don't WANT to stop drunk driving. Mandatory 5 years in prison first offense, no way out of it, make it VERY well known and drunk driving would plummet.
People have SOME sense, and knowing a monetary fine and probation etc isn't cutting down the # of people out there endangering other peoples lives. Solution ? INcrease the penalty to the point people WILL NOT drink and drive.
Yes, it would work. No, it will never happen because lawyers make millions off drunk driving cases.
