RALEIGH, N.C. (AP) - DNA testing in the Duke lacrosse rape case found genetic material from several males in the accuser's body and her underwear - but none from any team member, defense attorneys said in court papers Wednesday.

The papers were filed by attorneys for the three lacrosse players charged, Reade Seligmann, Collin Finnerty and David Evans. They complained that the information about DNA from other men was not disclosed in a report prosecutors provided earlier this year to the defense.

The testing was conducted at a private laboratory for the prosecution.
"This is strong evidence of innocence in a case in which the accuser denied engaging in any sexual activity in the days before the alleged assault, told police she last had consensual sexual intercourse a week before the assault, and claimed that her attackers did not use condoms and ejaculated," the defense said.

In an interview, defense attorney Joseph Cheshire said the findings suggest the accuser had sex shortly before the March team party where she was hired to perform as a stripper. The woman has said three lacrosse team members gang-raped her in a bathroom at the party.

District Attorney Mike Nifong did not immediately return a call for comment.
The trial is not expected to start until the spring.

RALEIGH, N.C. (AP) -- The woman at the center of the Duke lacrosse rape case is pregnant and due to give birth any day, roughly nine months after the team party where she says she was raped by three men in a bathroom.
The pregnancy was confirmed late Thursday by a person familiar with the case, speaking to The Associated Press on the condition of anonymity. Both Fox News and WRAL-TV in Raleigh reported she gave birth Thursday night.

This is an interesting turn of events ......... if the baby has Lacrosse player DNA, thats a death sentence. If it doesn't, MORE indications that she lied about the sex she didn't have before the "arpe" occurred.

So far, none of the seamen has matched any of the players. So we already know that she lied about the sex thing. The report said they found different types ofDNA, and none matched the Lacross playerDNA. I can only assume that means she had sex with a couple of different guys before or after the Lacross party.

There is also a report from a club owner wha said she was so drunk a night or two before the incident that people had to carry her out. They dropped her, and her legs got all cut up on the pavement.

Her medical examecited injuries to her legs as evidence of rape.

The head of a private DNA laboratory said under oath today that he and District Attorney Mike Nifong agreed not to report DNA results favorable to Duke lacrosse players charged with rape.
Brian Meehan, director of DNA Security of Burlington, said his lab found DNA from unidentified men in the underwear, pubic hair and rectum of the woman who said she was gang-raped at a lacrosse party in March. Nurses at Duke Hospital collected the samples a few hours after the alleged assault. Meehan said the DNA did not come from Reade Seligmann, David Evans, or Collin Finnerty, who have been charged with rape and sexual assault in the case.
Meehan struggled to say why he didn"™t include the favorable evidence in a report dated May 12, almost a month after Seligmann and Finnerty had been indicted. He cited concerns about the privacy of the lacrosse players, his discussions at several meetings with Nifong, and the fact that he didn"™t know whose DNA it was.
Under questioning by Jim Cooney, a defense attorney for Seligmann, Meehan admitted that his report violated his laboratory"™s standards by not reporting results of all tests.
Did Nifong and his investigators know the results of all the DNA tests? Cooney asked.
"œI believe so,"� Meehan said.
"œDid they know the test results excluded Reade Seligmann?"� Cooney asked.
"œI believe so,"� Meehan said.
Was the failure to report these results the intentional decision of you and the district attorney? Cooney asked.
"œYes,"� Meehan replied.
At that answer, several people in the packed courtroom clapped. Superior Court Judge W. Osmond Smith III warned the standing-room only crowd to be quiet or leave.
Meehan"™s testimony differed from a statement Nifong made at the beginning of today"™s hearing.
"œThe first I had heard of this particular situation was when I was served with this particular motion"� on Wednesday, Nifong told the judge. After court, Nifong clarified his remarks to say that he knew about the DNA results.
"And we were trying to, just as Dr. Meehan said, trying to avoid dragging any names through the mud but at the same time his report made it clear that all the information was available if they wanted it and they have every word of it,"� Nifong said.
Joseph B. Cheshire V, a lawyer for Evans, said he was troubled by today"™s testimony.
"œIf any of the lacrosse players were excluded, they simply wouldn"™t put it in the report,"� he said. "œIt raises some troublesome questions about (Nifong), who has an obligation to disclose exculpatory evidence and turn it over to the defense."�
In a response to reports that the accuser in the Duke lacrosse case gave birth recently, UNC Health care issued a statement at about 1:30 p.m. saying that the woman is at UNC Hospitals for care related to her pregnancy but has not given birth.
