Im going to actually side with Bush on this bill.Remember after Katrina hit, New orleans turned into a swimming pool, and everyone was pissed off because no federal help was arriving?There was a total breakdown in the chain of command there, the state didnt ask for assistance when it became obvious what was happening and by the time they did it just took that much longer to get through the red tape and get the guard in there.There was enough public outcry and media outrage that it would look absolutely foolish to run down a bill that would do exactly what they were outraged about to begin with.

Theres how many million illegal aliens in the United States?Once again the public outrage is where the local and state authorities arent able to or are unwilling to detain and deport these people.You see itoften in the news, a highway patrolman stops a vanload of illegals and has to let them go,, things of that nature.Detention centers fill that role.The majority of people in the US want these illegals gone, but if they were to get serious about rounding them up and shipping them back they number in the millions, where are you going to house them in the transition?Id almost rather see the money going into things like this then I would a fence thats effectiveness is questionable.I hope they make good use of them and start a massive roundup of illegals to hold there on the way back to Mexico.I dont care if they use the National guard, Army, and Air Force to get the job done either.

A lot of what I see in this bill is just giving the American people what theyve been bitching about for a couple years now.You cant have a fast response time when your buried in beuracrasy, you cant hold people where theres no facilities available, and you cant solve any of these domestic problems and keep a politically correct outlook on the problem and solution.In this case Bush is damned if does something and damned if he doesnt.

I haven't had a chance to review it yet, but, I'm skeptical about the analysis in the article. After all, it'sthe San Francisco "Independent" Media Center (as if there is anything "independent" in San Francisco), and cites Sen. Leahy as it's main source... and their analysis of the Military Commissions Act is WAY off base (They say it"allows for torture"...which is complete and total BS since the MCA specifically states that information obtained by torture is not admissable).

And it says the detention camps are "designed for anyone who resists the foreign and domestic agenda of the Bush administration." Yeah, that's an unbiased analysis...


Here is the text of the "odious" provision...read it and weep:

SEC. 1076. USE OF THE ARMED FORCES IN MAJOR PUBLIC EMERGENCIES.

[ul](a) Use of the Armed Forces Authorized-[/ul]

[ul][ul](1) IN GENERAL- Section 333 of title 10, United States Code, is amended to read as follows:[/ul][/ul]

`Sec. 333. Major public emergencies; interference with State and Federal law

[ul]`(a) Use of Armed Forces in Major Public Emergencies- (1) The President may employ the armed forces, including the National Guard in Federal service, to--[/ul]

[ul][ul]`(A) restore public order and enforce the laws of the United States when, as a result of a natural disaster, epidemic, or other serious public health emergency, terrorist attack or incident, or other condition in any State or possession of the United States, the President determines that--[/ul][/ul]

[ul][ul][ul]`(i) domestic violence has occurred to such an extent that the constituted authorities of the State or possession are incapable of maintaining public order; and[/ul][/ul][/ul]

[ul][ul][ul]`(ii) such violence results in a condition described in paragraph (2); or[/ul][/ul][/ul]

[ul][ul]`(B) suppress, in a State, any insurrection, domestic violence, unlawful combination, or conspiracy if such insurrection, violation, combination, or conspiracy results in a condition described in paragraph (2).[/ul][/ul]

[ul]`(2) A condition described in this paragraph is a condition that--[/ul]

[ul][ul]`(A) so hinders the execution of the laws of a State or possession, as applicable, and of the United States within that State or possession, that any part or class of its people is deprived of a right, privilege, immunity, or protection named in the Constitution and secured by law, and the constituted authorities of that State or possession are unable, fail, or refuse to protect that right, privilege, or immunity, or to give that protection; or[/ul][/ul]

[ul][ul]`(B) opposes or obstructs the execution of the laws of the United States or impedes the course of justice under those laws.[/ul][/ul]

[ul]`(3) In any situation covered by paragraph (1)(B), the State shall be considered to have denied the equal protection of the laws secured by the Constitution.[/ul]

[ul]`(b) Notice to Congress- The President shall notify Congress of the determination to exercise the authority in subsection (a)(1)(A) as soon as practicable after the determination and every 14 days thereafter during the duration of the exercise of that authority.'.[/ul]

[ul][ul](2) PROCLAMATION TO DISPERSE- Section 334 of such title is amended by inserting `or those obstructing the enforcement of the laws' after `insurgents'.[/ul][/ul]

[ul][ul](3) HEADING AMENDMENT- The heading of chapter 15 of such title is amended to read as follows:[/ul][/ul]

`CHAPTER 15--ENFORCEMENT OF THE LAWS TO RESTORE PUBLIC ORDER'.

[ul][ul](4) CLERICAL AMENDMENTS- (A) The tables of chapters at the beginning of subtitle A of title 10, United States Code, and at the beginning of part I of such subtitle, are each amended by striking the item relating to chapter 15 and inserting the following new item:[/ul][/ul]

[ul][ul](B) The table of sections at the beginning of chapter 15 of such title is amended by striking the item relating to sections 333 and inserting the following new item:[/ul][/ul]

[ul][ul]`333. Major public emergencies; interference with State and Federal law.'.[/ul][/ul]

[ul](b) Provision of Supplies, Services, and Equipment-[/ul]

[ul][ul](1) IN GENERAL- Chapter 152 of such title is amended by adding at the end the following new section:[/ul][/ul]

`Sec. 2567. Supplies, services, and equipment: provision in major public emergencies

[ul]`(a) Provision Authorized- In any situation in which the President determines to exercise the authority in section 333(a)(1)(A) of this title, the President may direct the Secretary of Defense to provide supplies, services, and equipment to persons affected by the situation.[/ul]

[ul]`(b) Covered Supplies, Services, and Equipment- The supplies, services, and equipment provided under this section may include food, water, utilities, bedding, transportation, tentage, search and rescue, medical care, minor repairs, the removal of debris, and other assistance necessary for the immediate preservation of life and property.[/ul]

[ul]`(c) Limitations- (1) Supplies, services, and equipment may be provided under this section--[/ul]

[ul][ul]`(A) only to the extent that the constituted authorities of the State or possession concerned are unable to provide such supplies, services, and equipment, as the case may be; and[/ul][/ul]

[ul][ul]`(B) only until such authorities, or other departments or agencies of the United States charged with the provision of such supplies, services, and equipment, are able to provide such supplies, services, and equipment.[/ul][/ul]

[ul]`(2) The Secretary may provide supplies, services, and equipment under this section only to the extent that the Secretary determines that doing so will not interfere with military preparedness or ongoing military operations or functions.[/ul]

[ul]`(d) Inapplicability of Certain Authorities- The provision of supplies, services, or equipment under this section shall not be subject to the provisions of section 403(c) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5170b(c)).'.[/ul]

[ul][ul](2) CLERICAL AMENDMENT- The table of sections at the beginning of such chapter is amended by adding at the end the following new item:[/ul][/ul]

[ul][ul]`2567. Supplies, services, and equipment: provision in major public emergencies'.[/ul][/ul]

[ul](c) Conforming Amendment- Section 12304(c)(1) of such title is amended by striking `No unit' and all that follows through `subsection (b),' and inserting `Except to perform any of the functions authorized by chapter 15 or section 12406 of this title or by subsection (b), no unit or member of a reserve component may be ordered to active duty under this section'.

I read it about that far myself ispc, and that was more than enough. You don't have to get into it far at all to see it's blatent bull, and the "facts" stated there are even less reliablethan the "extended" weather forcast.

Evidently even the left-wing media feels that report is too ridiculous to broadcast.

The very next section of the Act is designed to increase hunting and fishing opportunities for disabled vets on public lands:

SEC. 1077. INCREASED HUNTING AND FISHING OPPORTUNITIES FOR MEMBERS OF THE ARMED FORCES, RETIRED MEMBERS, AND DISABLED VETERANS.

[ul](a) Access for Members, Retired Members, and Disabled Veterans- Consistent with section 2671 of title 10, United States Code, and using such funds as are made available for this purpose, the Secretary of Defense shall ensure that members of the Armed Forces, retired members, disabled veterans, and persons assisting disabled veterans are able to utilize lands under the jurisdiction of the Department of Defense that are available for hunting or fishing.[/ul]

[ul](b) Assessment- Not later than 180 days after the date of the enactment of this Act, the Secretary shall submit to Congress a report containing the results of an assessment of those lands under the jurisdiction of the Department of Defense and suitable for hunting or fishing and describing the actions necessary--[/ul]

[ul][ul](1) to further increase the acreage made available to members of the Armed Forces, retired members, disabled veterans, and persons assisting disabled veterans for hunting and fishing; and[/ul][/ul]

[ul][ul](2) to make that acreage more accessible to disabled veterans.[/ul][/ul]

[ul](c) Recreational Activities on Santa Rosa Island- The Secretary of the Interior shall immediately cease the plan, approved in the settlement agreement for case number 96-7412 WJR and case number 97-4098 WJR, to exterminate the deer and elk on Santa Rosa Island, Channel Islands, California, by helicopter and shall not exterminate or nearly exterminate the deer and elk.

Wow, I guess we wouldn't want the President (or any other law enforcement official for that matter) to enforce those pesky laws of the United States. After all, we don't need no steeenkin' laws.[8D]
