A hunter who fatally shot an undocumented immigrant on a South Texas
ranch when he mistook him for a hog should not be indicted, a Maverick County grand jury decided. The no bill means Jaime Gonalez will not be charged for the 2004 shooting near El Indio. Gonzalez, of Eagle Pass, told authorities he was shooting at a wild hog about 150 feet away when Celestino Lopes was struck in the abdomen. Lopez, 36, and a group of immigrants had stopped and stood in the darkness. After the shooting, Gonzalez put Lopez in a pickup and met an ambulance on the way to the hospital. - Associated Press.[/align]

I would bet that if it had been "John Smith" who shot the illegal rather than Jaime Gonzalez, they would have tried to indict him for a hate crime.

IT seems to me this same thing happened in Ohio last year also.
Some guys coyote hunting at night killed another hunter.

January 17, 2006 - Authorities think a Northwest Ohio man was shot after he was mistaken for a coyote by other hunters.
VAN WERT, Ohio (AP) - A man on a nighttime coyote hunt was shot and killed by another hunter in an apparent accident, authorities said.
Trevor Ellerbrock, 27, of Van Wert, was in a field about 9:38 p.m. on Sunday, trying to attract coyotes by using a recording device that played squealing sounds of a rabbit, authorities said.
Two other hunters in the same area - Troy Clark, 36, of Van Wert and a 15-year-old boy - mistook Ellerbrock for a coyote, according to the Van Wert County Sheriff's Office. One of the them fired a round and shot Ellerbrock in the midsection, the sheriff's office said.

The Ohio Department of Natural Resources and the sheriff's office said Monday that the shooting remained under investigation.

Wish I could just throw my trophies in the back of the pickup and hand them off to the local medics. I bet an emergency room surgeon couldfield dress a trophy in record time! And it's so clean! No worries of bugs in your meat, bacteria, and the like.
