Is there such a thing as too defenseless to be incarcerated ?

But I'm too small to make it in prison !

A child molestor in Nebraska was recently given a sentence that the State Attorney General is appealing on grounds that it's too light for the offense . The judge had sentenced the defendant to a stint of probation simply because of his slight stature and her conjecture that he "wouldn't survive in prison" .

Who is right in this case ?

The judge says she doesn't think he would suvrive in prision.Some one is going to have to help me with the down side of him not surviving.

The Nebraska AG is appealling the case. I'd bet the guy is sent somewhere. And I bet he suffers for his crimes.

Let's see now--should we concern ourselves more with some child-molesting freak who's too small to survive prison, or some defenseless child who's too small to fend off a pervert like this animal?

I'm keeping my fingers crossed that this guy runs into the wrong person outside of prison.
