Default Snooze-gate: Time for Ruth Bader Ginsburg to Resign

The 72 year old Supreme Court justice apparently can't stay awake during arguments before the Court. Is this someone who should be sitting on the highest court in the land?

It's time for the liberal Ginsburg to resign and let Bush appoint another strict constructionist.

And I'm outraged that the ultra-liberal media failed to plaster this all over the headlines but instead buried it in an AP report. The American public has a right to know. The libbies have too much secrecy.

Image the uproar if it had been Thomas or Scalia.

But really, it demonstates to me how much of the research and supporting opinion is made by law clerks. I wonder how much of what is argued in the actual court really affects the outcome?

I have heard of mistrials being declared in court cases due to jurors sleeping, why should it be acceptable for a SC to sleep on the job?

Time for her to retire and sleep at home.

Thankfully no one can make that decision but her (not that I support her judicial doctrine, just the system of checks and balances). Didn't John Q. Adams sleep in congress all the time (after his presidential term)? Doesn't sound like this was an exciting case and I'm sure that any justice will re-read any pertinent argumentsof the case if they areundecided

Time for Ms Ginzberg to retire to the rocking chair on the porch with a quilt in her lap and write her memoires!!!

I don't know how common this is. I guess I wouldn't want to make too much of it if it does in fact happen commonly. If it truly is rare, I think the news media should jump all over this. What is the significance of the Vice President having a hunting accident? None. What is the significance of a US Supreme Court justice sleeping during oral arguments? In a case deciding whether the voting rights of minority voters have been materially damaged by state legislation? SIGNIFICANT!!!

I read the post that the judge can read the trial transcripts, but to buy this argument leads one to the conclusion that oral arguments are unnecessary. Why EVER have oral arguments if there is no real difference between being present in the court room and attending while the oral argument is presented? Why not have the presenter capture their presentation on video tape and view at the justice's convenience?

I'm not holding my breath for this to rise to the media frenzy that the Cheney shooting or the Dubai port leasing deal rose to, but it should.

Ever been to a session of congress? Talk about not paying attention. Most oral arguments take place in front of a very meager amount of actual congressmen, if any, and although members have video equipment linked to the senate/house floor, many are off doing something else. Many don't even vote on all the issues b/c of ????????? (who knows what).

I'm not defending any of this behavior, I'm just merely stating facts. Welcome to democratic government in the 21st century (or even late 20th century). I doubt any pertinent judicious points will "slip thru the cracks" because of one of the justices nodding off. They've always been old farts for the most part. I'm sure its happened before.

It certainly isn't professional nor is it appropriate. If this were a lower court judge falling asleep, you can bet any decision would likely be reviewed and possibly overturned. It may be a technicality but who would seriously want their life on the line with a judge falling asleep when your lawyer is arguing your case?????

Well this is an old mans opinion having been raised in the old school!!

If Iwas in a job that determines the laws and rights of every individual citizen in the US and I can not stay awake to do my job, I would retire!!!!

She is from the old school also, but obviously she was not taking the self pride and self responsibilty courses I did, or she was sleeping during those also!
