Foreign nationals are not protected under our constitution. If they represent a threat to national security, local security, or the neighborhood stray cats, we should do what needs to be done. This is our house, our people, our law.
If they come here legally, with normal good intentions, and earn citizenship, they may move in next door to me and I'll help them unload and unpack.

Now ifanyone wants to come-up with a list of what "compelling" intrests might be, I am all ears and more than open to discussion, but I am against our goverment routinely listening in on anyphone calls for no other reason than that they can.

If Juan is an illegal immigrant and he is planting trees on the neighbors property, and he comes to my house to borrow the phone, it is a phone call that falls under the discription given in the original post.
They still have no right to tap my phone just because Juan has no or fakedpapers, and the fact thatJuan may come back tommorow to ask to use the phone again.
There has to be some compelling reason beyond the fact Juan is not a USA citizen.
Now if there is suspecion that Juan is a drug mule..........

everyone is at an agreeance on this topic....so what ya'll are saying it's o.k. to spy on illegal's. so what makes it any worse spying on people who are helping terrorist organizations? in my opinion, even if you are a citizen, if you're helping the enemy or in conjunction with them, you are committing treason and should no longer be considered a citizen.

Mr. Pirk, if it is already legal for the government to tap illegals' phones, your argument is one against currently existing law that has been in practice long before the Patriot Act. I personally think the Fed court (FISA) is a more appropriate venue for getting wiretaps approved. If there is a problem with how fast the court can act, then that problem should be addressed with the Patriot Act or some other legislation. It should be a streamlined process that allows the government to act quickly when somebody is suspected of being a terrorist. And like any other court order for a wiretap, search, etc., the court reviews whatever evidence is obtained and makes any determinations on continuing the wiretap, etc.
