Default Drunk drug tester.

I own a couple of buisnesses, and in accordancewith state law, I must have periodic and random drug tests for all my C.D.L. holders. The other day I was called to come down to this sight because the drug tester was in and was apparently drunk. He had started doing random test before lunch, and had to wait until after lunch to finish. When I arrive, he was in the process of giving one of my employees a breathalyzer test. I pulled him off to the side to speak to him and was taken by the ever present smell of alcohol. I told him I don't appreciate him comingto my sightin that condition and told him he was done. Later that day, while in the process of composingmy grievance, I receive a call from the company who we hired to do these test. They complaining about me sending him home with out completing he's job and that theyare turning this over to the state.I explained what had happened and that I was in the process of filling a grievance against him. It was then explained to me that he always has a beer with lunch when he goes out and that was not a big deal. I then took the opportunity to tellthis individualthat my phone conversations are taped and that I reserve the right to use this conversation in my grievance. They agreed and asked me to go on. I then explained our business is in a dry county and the nearest establishment that serves beer is over an hour away. I then preceded to tell him that for his tester to have had a single beer at lunch would have meant he had to have brought it himself, and that alone was grounds for me sending him home (alcohol is not permited on the grounds he was testing at). They said little. I then explained about how bad he smelled and that it was by all means more than beer. Also our video shows him staggering in the door, wrestling with his equipment. They held to their guns, but would wait to see my grievance before they turned this over to the state. I told them, "do as you wish, but I will still be contracting another company to do my tests." Once he had left your place of business, you should have contacted LEO and let them arrest the SOB. Then there would have been 3rd party independent corroboration.

But then, that's just my .02 worth...
