Police's fault that the kids weren't supervied well, climbed into a car trunk and died there ? Why the hell are the parents not responsible for not finding them too ? Tragic accident ........ police and vounteers etc worked like hell to try and find the kids, no blame is on their shoulders at all !
I can see it now ......... you call the police, and when they arrive you have to sign papers saying you won't hold them accountable for trying to help ? PATHETIC[:@]
So the police are not obligated to protect an individual citizen against a known threat, but they are obligated to findchildren thatnegligent parents don't bother taking care of.
The cops didn't look behind my left nad either , but it doesn't mean that they killed those kids . How the hell is this any of their fault anyway? They did their job , the parents didn't . [:@]

I wouldn't get to worked up about it. There is no duty to provide for police protection, and governments and their officials typically enjoy immunity from most causes of action. Just because somebody files a suit doesn't mean they have a snowball's chance at winning.

While your statements is correct in assuming they probably won't win anything in court for this, the fact remains that cases such as this cost all of us millions of dollars every year in administrative costs. This is another prime example of the need for a loser pays system in civil suits, or perhaps a losing attorney pays which would work even better.

The U.S. pretty much stands alone among western democracies in not implementing some sort of loser-pays system. I don't know enough about them to comment on them. I think if it were done carefully, it might be a positive thing. If not, the cure could be worse than the disease.
Rule 11 of the Federal Rules of Civil Procedure is designed to thwart unmeritous claims, but it is neither used nor enforced very often.

So enforce the damn rule for the next 5000 or 6000 case over the next 3 weeks and lets see just how bad it might be. I'm really tired of reading and hearing first hand of this nonsense. Shakespeare had it right. "First kill all the lawyers" Yes I know there are actually lawyers that do good in this country, but the other 98% give them a bad name.
