Since the incident happened in Taxachusetts I'm not surprised , but why should it be legal for the cops to haul you away if you're on private property and not causing a disturbance or posing a risk to yourself simply because you're intoxicated? Why was he the only one arrested at a party filled with bottle throwing drunks?Enquiring minds want to know .

In WI private or public property no one gets arrested for being drunk.
That is not to say Disorderly Conduct or driving but just plain drunk is not a crime.
If you are intoxicated and unable to care for yourself or have someone to care for you, public or private property, the worst that happens is you get sent to a detox center. That has been the law here for over 20 years.

Being intoxicated is consider the same as being sick, mentally ill or any codition that renders one incapable of caring for oneself.
States differ but this sounds like a stupid move on the part of the LEOs.

Exactly logs . In Arkansas you can be arrested for public intox if you are a danger to yourself or others or others property.
But you better be able to articulate the incident very well in court.

I have lately been very concerned about our law enforcement community the quality of people that is.
I have had many people i know to be honest hard working people have run in with LEO's and they said they didnt do anything.
I discounted it BUT then i had mine!!!!!!

I had a Arkansas Highway Police officer stop me going to work one night back in april. he stated he paced me at 75 in a 60 ...OK ?
FROM THE SERVICE ROAD AND I WAS ON THE INTERSTATE IN THE MIDDLE LANE WITH 18 WHEELERS BETWEEN ME AND HIM!!!!!!!!!

I know i was going a little over 60 but not 75!!!!!

We spoke and i said i would definately see him in court.

I have done a few things to prepare for my sept trail date. but i am preparing to go see the director of the highway police about the tactics that he used.

Anyway i am a former officer that is changing my opinion QUICKLY!!!!!!
