Default NY Hunters, did U notice more posted signs when they legalized rifles in your county?

An area that I've hunted for the past 15 years was posted last year.I don't know if it was because of rifles being legal.I bowhunted their last year for 3 weeks before the guy put his signs up.
What bothers methe mostis that they took a homemade deer stand that my boy and me built together and put in the woods. He's in Iraq now.
I also saw the biggest buck of my lifeabout 30 yards from where we put our stand.
I can't talk to the guy who owns the land because he lives in NY City.I live in Tioga county.

Maybe the landowner posted his land because people were tresspassing and hunting on his land without permission.

No offense, but did he know you have been hunting on his land? Maybe he found your stand and got pissed off. I'd try to contact him and ask for permission.

I haven't notice an increase in posted signs in my area except on my own land. Mainly because NY has this rediculeous law that states if it's not posted, hunters can hunt it??

I could see why many land owners would post, especially if they have a camp or house on the property. I wouldn't want a hunters with rifles on my property just in case they don't identify there target and "BEYOND" it.

I had posted a few years ago to keep trespassers out, you know, those that think because they own 1 acre, they own yours as well. Just 2 weeks ago I refurbished a bunch of them since I put in food plots, not because of the rifle's.

From the NYSDEC website

Q. Must I post to keep people off my property?
A. No. Trespassing is illegal even on unposted property, unless it is unimproved, apparently unused and unfenced (or not otherwise enclosed to exclude intruders.) Even on vacant land, a written notice delivered in person (or by certified mail with a signed receipt, etc.) to any person, in the name of the landowner or authorized party, containing a description of the premises and a warning of restrictions which apply has the same effect, for that person, as if the land were posted with those restrictions. Likewise, anyone asked to leave the premises, posted or not, by the landowner, occupant or other authorized person, must do so immediately.

All depends on who you talk to in the DEC I guess. Last year I thought a deer I hit ran onto a neighboring property that I can't go on. I called the DEC for advise and they told me that if the land isn't posted I can go on it when ever I want untill they post it or verbally tell me that I have to leave. He aslo said the land owner has to post their property legally by sept. 1 st but that rarely happens. But that is also a loop hole, At work we tresspass people from the private property and without written notice of a tresspass they can't be prosecuted in NY. I'll look in the penal law to see what it actually states.

CharlieP, the key wording is
Quote:
unless it is unimproved, apparently unused and unfenced (or not otherwise enclosed to exclude intruders.)
. I have 92 acres, my camp/house is near the road and not visible to the other 80 acres due to a hill. So trespassers have a way out if you do try to proscute, "How was I suppose to know, its looks unimproved and unused to me". Really Charlie, how do woods look like when there used? I hear you, but you need to post. The law states every 660 feet, I do it every 50 feet, again, loopholes for the criminals. "How was I suppose to know, its a wilderness in there and you expect me to see a sign approx. 300 feet away". I wish NY law was like other statesthat require the hikers, hunters, etc. to know the bountries, so this way we wouldn't have to litter our property with the signs.

Oh well, life goes on. Thanks for the help anyway CharlieP, most people do respect land owner rights.

You know it is funny I have also seen more posted signs, I also live in Tioga county. The big heated discusion over how dangerous rifle was going to be, and we had the safest hunting season on record I heard of one fatality and that guy shot himself with a shotgun. So let them post their land and when the deer are wraped up in their cars, or eating all their crops they will be crying next year that the deer population is too large they will have to have a pest permit to get rid of them and open their land back up to get the permit.
