Default Let's say you shoot an elk....

And you live in FL.

OK....it could happen. You see an elk.....and you shoot it (or any animal not indigenous to your state).

I wanna know.....if there is no season on that animal in your state.....is it legal? Or....is it illegal BECAUSE there is no season on this species???

Absolutely NO.

Missouri's Wildlife Code is a "permissive code," meaning that if you're not explicitly given permission (a season has been created), then it's against the law to kill that species.

Illegal in Wisconsin, We now have Elk but until this herd is healthy and big enough no season.
I hear wolves are having a big impact on them so it could be awhile.
Now that wolves are off the endangered list in Wisconsin I could possibly see a season
somewhere down the road.

I asked a game warden a few years ago about mountain lions in Pa.He said there are none.I said then if I see one,I could kill it.He told me,"No,they're protected".I just laughed and walked away

It doesn't have to be isolated to elk. He's giving elk as an example because obviously, FL has no Elk population...

In PA, like Greg stated in MO, if there is no open season, it's implied that the seasons are closed. No animal can be shot without an outlined season, HOWEVER,

Apparently there is a small pop of wild hogs now establishing themself. There is no open season on wild hog and it's not illegal to shoot them.

I understand that although the PGC claims there are no mountain lions in PA, there is a $3000 fine if you shoot one. Go figure. [&:]

it would be illegal . my state saysthat all animals and birds are the property of the state or federal government and that you need their permission to shoot or be in possession of one
